Another Contractor Takes Liberties with the Safety of Others

Today, in the Journal News, there was an article about a recent OSHA violation in Yonkers.  

Four contractors working at the School 6 housing site were fined $115,230 by federal authorities alleging safety lapses.

Inspectors from the Occupational Safety and Health Administration visited the work site at 33 Ashburton Ave., where the Municipal Housing Authority for the City of Yonkers and The Community Builders are erecting affordable senior and family housing that will replace some of the apartments at the adjacent Cottage Place Gardens public housing project.

Masonry subcontractor MPCC Corp. of New Rochelle; heating, ventilation and air conditioning subcontractor Zodiac Industries Inc. of Port Chester and general contractor SNE-MPCC-Mengler J.V. and subcontractor Mengler Plumbing, both of Brewster, were cited for violations during the May inspections related to scaffolding and electrocution hazards.

"Falls and electrocution are among the top four causes of injury and death for people in the construction industry," said Diana Cortez, OSHA's area director in Tarrytown, whose office issued the fines Nov. 7. "These hazards can be readily prevented when employers adhere to basic, common sense and legally required safeguards. Unfortunately, those safeguards were lacking at this job site, placing workers at risk."

The biggest fines of $91,630 were assessed to MPCC Corp. for three repeated and 17 serious violations.

Each employer has 15 business days from receipt of its citations and penalties to comply, request an informal conference with OSHA's area director or contest the findings before the independent Occupational Safety and Health Review Commission.
