5 steps to take after getting hurt in a pedestrian accident

In the first several days and weeks following an injurious pedestrian accident, there are some specific things that the injured pedestrian can do to protect his or her right to seek compensation relating to the incident. While some of these things are best done at the accident scene itself, if the injuries are severe, the pedestrian may not be able to perform them. As such, these steps are just as important for close family members or friends of injured pedestrians, who might be present to help following a tragic accident.

Here's what injured pedestrians should do after an accident

By carrying out the following five steps, pedestrian accident victims will increase their chances of success in pursuing damages from at fault parties:

1. Take notes: Write down information pertaining to conversations with those who are involved in the crash. What did passersby see? What did the driver of the car that hit the pedestrian say happened? What do you, or the injured pedestrian think happened? Was anyone else present or involved in the incident? Take notes on what they say, too.

2. Preserve evidence: Note who may have caused the accident, note the extent of damages and physical injuries, and take photos of the accident scene, people involved, and their injuries. Also, save evidence like torn or blood-stained clothing and/or broken pieces of vehicles.

3. Identify witnesses: Make a list of the names and contact information, as well as drivers' license and vehicle identification information, for any witnesses and anyone who may have been involved.

4. Save information relating to costs: Save any and all receipts and information pertaining to costs and financial losses incurred due to the accident. This especially applies to medical costs and doctors' bills. Also, note any lost wages incurred as a result of not being able to work.

5. Put at-fault parties on notice: Through a personal injury lawyer, contact the parties you believe are at fault and liable for the accident and tell them that you intend to file a claim for damages. This is especially true in the case of the at-fault party being a government employee or agency.

Consider contacting a personal injury lawyer

Finally, at some point while carrying out the steps above, and as soon as possible, consider getting in touch with a personal injury attorney to evaluate your potential claim for damages. A personal injury lawyer will have a good sense of whether a pedestrian injured in a car accident will be considered to blame for an accident, or whether the injured pedestrian will have a viable claim for seeking financial damages relating to the incident. The attorney will also be able to identify the most suitable strategy for seeking those damages from the at fault and liable party or parties.
